License Agreement

By installing MobileLog software, you are agreeing to be bound by 
the terms of this agreement. If you do not agree to the terms
of this agreement, promptly exit the setup program and remove the
installation program.

COPYRIGHT. The SOFTWARE including source code, documentation, design, and
structure is the proprietary property of Patrick Rundall & N0HRsoft and 
is protected by copyright laws and international treaty provisions. 
Title to the Program, or any copy, modification or merged portion 
of the Program, shall at all times remain with Patrick Rundall. 
Therefore, you must treat the software like any other copyrighted 
material except that you may :

(a) make one copy of the SOFTWARE solely for backup or archival purposes,
or 
(b) transfer the SOFTWARE to a single hard disk provided you keep the
original solely for backup or archival purposes, 
or 
(c) transfer the SOFTWARE to a single system, which includes a host computer
with a hard disk and one Pocket PC or Handheld device, provided you keep the
original solely for backup or archival purposes. The backup copy
must include all copyright information contained in the original.
You may not copy the written materials accompanying the SOFTWARE.
(d) This licence grants you the right to use MobileLog on one 
Pocket PC or Handheld device at a time. To use MobileLog on multiple 
Pocket PC or Handheld devices at the same time, you need to purchase one copy of
Pocket Controller for each device.

You may not: 
(a) Transfer or rent the Program or use, copy, modify, distribute the
Program in whole or part, except as expressly permitted in this agreement. 
(b) Unassemble or otherwise reverse engineer the Program.  


If you do any of the foregoing, your rights under this license will 
automatically terminate. Such termination shall be in addition and 
not in lieu of any criminal, civil or other remedies available to 
N0HRsoft.


DEMONSTRATION, BETA AND LICENSED VERSIONS

"Demonstration" or "Demo" versions of MobileLog may be used for a
limited time to evaluate MobileLog for purchase and may contain
partial functionality. Using demonstration versions beyond the 
permitted date is a violation of this license.

"Beta" versions of MobileLog may be made available to the general
public to assist in the development of the product (testing). They
may be limited in functionality and/or "expire" beyond a certain
date.

"Licensed" copies of MobileLog are those that have been registered
via the online registration process. 

None of the above should imply that a particular version is 
completely free of known defects. 


LIMITED WARRANTY

Except as specifically stated in this agreement, the Program is 
provided and licensed "as is" without warranty of any kind, 
either express or implied, including, but not limited to the 
implied warranties of merchantability and fitness for a particular 
purpose.  

N0HRsoft does not warrant that the functions contained in the 
Program will meet your requirements or that the operation of 
the Program will be entirely error free or appear precisely 
as described in the Program documentation.


LIMITATION OF REMEDIES AND LIABILITY

To the maximum extent permitted by applicable law, the remedies 
described below are accepted by you as your only remedies. As
a working demonstration version of the product has been made
available to test functionality, you should be able to determine
whether the product will perform sufficiently on your device.

A) In the event that a registered version of MobileLog contains
significant defects that did not present themselves in the
demonstration version, you may, within 30 days of purchase,
write to N0HRsoft with notification of all known defects that
prevent operation and did not appear in the demo version. If
N0HRsoft is unable to correct the defect within 90 days of
receiving your report, you may terminate your license and this 
agreement by removing all copies of the software from your
device and mailing the original receipt to N0HRsoft. Your 
money will then be refunded.

To the maximum extent permitted by applicable law, in no event 
will N0HRsoft be liable to you for any damages, including lost 
profits, lost savings, or other incidental or consequential damages, 
arising out of the use or inability to use the Program, even if 
N0HRsoft or a dealer authorized by N0HRsoft had been advised of the 
possibility of such damages.


UPGRADE POLICY AND VERSIONS

N0HRsoft will release new versions of MobileLog as deemed necessary
by N0HRsoft. "Minor releases" are versions that increment to the
right of the version decimal place. "Major releases" increment to
the left of the decimal place. 

Registered/licensed users qualify for free upgrades of minor releases
once available.

Example:
A user purchases a license for MobileLog version 1.0. Subsequently,
a minor release is published (version 1.1) to correct a few defects
and add some enhancement. The user would be entitled to a free
upgrade to version 1.1

However, that same user would be required to purchase an upgrade
in order to use version 2.0 (which could contain major changes to
the product).


GENERAL

N0HRsoft does not guarantee the performance of the Program for 
use under every possible configuration. If any provision of this 
agreement is held to be unenforceable, the enforceability of the 
remaining provisions shall in no way be affected or impaired thereby.
